The 2 vehicle accident took place about 6 am on Thursday morning.
Police and emergency officials rushed to the area of 40 just South of Confederation Line.
Both drivers were taken to the hospital, one with minor injuries and the other with life threatening injuries.
That driver, 31 year old Luis Garcia Ventura of Windsor later succumbed to his injuries.
