Apartment Plan Given Green Light By Ontario Land Tribunal

A new Chatham apartment building will likely move forward following a decision by the Ontario Land Tribunal (OLT).

An OLT hearing was held on November 25, 2025, regarding a proposed nine-storey housing development at 50 Indian Creek Rd. S.

Chatham-Kent Council referred the matter to the OLT on August 11, 2025, rather than approve a settlement recommendation from municipal staff.

The developer had agreed to lower the height of the building from nine storeys to eight, and to transfer a portion of the property to the municipality at no cost for future road network extensions.

However, multiple councillors and residents still felt the building would still be too tall for the area.

With the necessary zoning in place, the developer is now required to obtain site plan approval prior to applying for building permits. The application has not yet been submitted.
