A hearing regarding zoning permissions for the contentious Dresden landfill site has been delayed.
The owners of the Irish School Road property, York1 Waste Solutions, served the municipality with a court challenge in the Ontario Superior Court of Justice last November, arguing that its proposed waste-processing facility does not require any land-use planning approvals from CK Council. Chatham-Kent maintains that zoning approvals are required, as the current zoning for the site does not permit a landfill or a large-scale waste-processing facility.
Due to the volume of documents submitted and the time required for Chatham-Kent’s legal team to properly review the materials and prepare, the court date has been rescheduled from September 21 to November 17.
York1 has submitted two applications to the Environment Ministry outlining plans to construct a waste transfer and processing facility at the landfill site that would receive, transfer, sort, and process non-hazardous waste, construction and demolition waste, wood waste, and soils.
York1’s plans have been met with significant opposition from local residents since they were made public in early 2024. Chatham-Kent Council and municipal administration also oppose the project in any form.
The municipality has been informed that the community will be able to provide feedback on York1’s plans for the landfill site through the Environmental Registry of Ontario (ERO) process. Once released, the community will have at least 45 days to provide comments.
Chatham-Kent is reminding the public that the court case will not provide a final determination of whether York1 can proceed with its proposed landfill and waste processing project.
