Chatham-Kent Council is set to vote on whether or not to financially penalize one of its own for code of conduct violations.
According to a recent report, Integrity Commissioner Mary Ellen Bench began an investigation in April after receiving several complaints regarding social media posts made by Ward 4 Councillor Rhonda Jubenville.
Bench said Jubenville used her influence of office and position as a public official to improperly voice comments about community matters, other councillors, and social issues in the community. The report specifically points to two Facebook posts that involve the LGBTQ community by referencing the Pride flag.
As a result, the integrity commissioner has recommended that Jubenville be issued a three-month pay suspension, which is the maximum penalty allowed.
Council will discuss and vote on the recommendation during a meeting on Monday. Jubenville will also be given the chance to speak to the matter, however, she has previously told CKXS News that her lawyer will be making a statement in her place.
Jubenville has disagreed with the integrity commissioner’s findings and said she believes the report violates her right to Freedom of Expression. She added that she is considering legal action depending on council’s decision but has not elaborated further.
Should council agree with the integrity commissioner’s recommendation, Jubenville’s three-month pay suspension would cost her $8,515.
Under the Municipal Act, council can impose one of two penalties for a violation of the code of conduct — a reprimand or a suspension of remuneration for a period of up to 90 days.
