“My Favourite Place to Shop” CONTEST Official Rules and Regulations (“Rules”)

Contest Period
The My Favourite Place to Shop contest (the “Contest”) starts at 6AM EST on March 22, 2021 and closes on April 16, 2021 at 5:59 AM EST (“Contest Period”). During the Contest Period, there will be four entry periods (each an “Entry Period”) as described in Section 6 below.
Contest Sponsors
The Contest sponsors are Xplornet Communications Inc. and Five Amigos Broadcasting Inc. and its participating radio station 99.1 CKXS (“CKXS”) (the “Sponsors”). The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook. Facebook is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to CKSX and not Facebook. You may only use one (1) personal Facebook account (the “Account”) to participate in this Contest. You agree to the privacy policies and terms of use of Facebook (available at www.facebook.com) and are solely responsible for ensuring that you comply with them at all times while participating in the Contest.
How to Enter
No purchase is necessary to enter. There are two ways to enter the Contest, simply log-in to your Facebook Account, visit CKXS Facebook page located at facebook.com/991CKXS and, during an Entry Period, either (i) post a comment (“Comment”) on CKXS post about the Contest which includes your favourite Chatham-Kent Retail Business and why its your favourite place to shop or (ii)post a photo (the “Photo”) of your favorite Chatham-Kent Retail Business (a Comment and Photo shall hereinafter be referred to as a “Submission” and collectively “Submissions”). Your Submission can be posted either in the comment section of the Contest post or in a separate post. If posted as a separate post, @CKXS must be tagged in the post. You must ensure your Facebook Account settings allows for public viewing of your Submission so that the Sponsors may register your entry. Your Submission must comply with the Submission Guidelines provided below. If your Submission is received during the Entry Period in accordance with these Rules, as determined by the Sponsors in their sole discretion, you will be eligible to receive one entry into the Contest. Limit of one entry per person each Entry Period . You cannot enter the same Submission more than once. If it is discovered that you entered more than once during each Entry Period and/or enter the same Submission more than once, all your entries will be void. For the purposes of this Contest, a “Chatham-Kent Retail Business” is defined as a local business operating in Chatham-Kent excluding a business that sells adult products or services, tobacco products and related paraphernalia, firearms, non-medical drugs, pharmaceutical drugs and marijuana. In addition, businesses that sell products and/or services in direct competition with Xplornet Communications Inc. are also excluded. A hyperlink to these Rules is included on the CKXS post about the Contest to signify that you have read and agree to be bound by these Rules.
Important Note: The Sponsors reserves the right to screen all Submissions. Any Submissions that the Sponsors deem, in their sole discussion, to violate the terms and conditions set forth in these Rules may be subject to disqualification. The Sponsors reserve the right at any time, it their sole discretion, to require proof, in form and substance satisfactory to the Sponsors and within the timeframe specified by the Sponsors, that: (i) confirms the entrant and the Submission meets all of the applicable requirements specified in these Rules; (ii) the entrant has all necessary permissions and authorizations as required pursuant to these Rules including permission from all persons (or from a parent or legal guardian if such person is a minor) appearing in the Submission; and/or (iii) is required for any other reason that the Sponsors deem necessary, in their sole discretion, for the purposes of administering this Contest in accordance with these Rules, or for any other reason. Failure to provide such proof to the complete satisfaction of the Sponsors within the timeline specified may result in disqualification in the sole discretion of the Sponsors.
Eligibility
The Contest is open only to legal residents of Ontario who are 18 years of age or older at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of the Sponsors and their respective affiliates, distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.
Prizes
Four prizes are to be awarded each consisting of one Xplornet tote bag, one hand sanitizer, one screen cloth and one hundred ($100) dollar pre paid credit card (each a “Prize” and collectively, the “Prizes”). Approximate retail value of each Prize is $110 CAD. The Sponsors reserve the right to substitute any Prize in whole or in part for a prize of equal or greater value in the event that any component of a Prize is unavailable for any reason. Prizes must be accepted as awarded and no substitutions, except as identified above, will be made. Prizes may not be sold, transferred or assigned and are not convertible to cash.

At approximately 8 AM EST on each draw date (each, a “Draw Date”), a random draw for a Prize will take place from among all eligible entries received during the corresponding Entry Period as set out above. The first entry drawn will be eligible to win a Prize. The odds of winning a Prize will depend on the total number of eligible entries received during the corresponding Entry Period. Non-winning entries will not be carried forward to subsequent Entry Periods and will not be eligible on subsequent Draw Dates. CKXS will attempt to notify each potential winner via an @reply, direct message or other means to his/her Facebook Account within 2 days of the applicable draw. In the event that a potential winner cannot be contacted within 2 days, he or she will be disqualified and an alternate potential winner may be drawn at the Sponsors sole discretion.
In order to be declared a winner, each potential winner must correctly answer, unaided, a time-limited mathematical skill-testing question administered by CKXS and be verified as complying with these Rules. Before being awarded a Prize, each potential winner will be required to sign and return, within the time stipulated by CKXS, a contest eligibility and liability/publicity release confirming among other things, compliance with these Rules, releasing the Sponsors and their respective directors, officers, shareholders and agents from all liability and, except where prohibited by law, permitting the Sponsors to publish, reproduce and/or use in any and all forms of media, the selected entrant’s name, address (city and province), photograph or other likeness, and/or his/her Submission, without further notice or compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsors. Each winner must also provide proof of identity in the form of a Driver’s License, Passport or any other government-issued photo identification upon request. In the event that a winner is not eligible for any reason or has not correctly answered the skill- testing question and returned the release form, he or she shall be disqualified and the Sponsors shall have the right to select another entrant and the Sponsors shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrants.
Submission Guidelines
Submissions must be original work and must not include any third party’s proprietary content, including trademarks or copyrighted content. The Sponsors in their sole and absolute discretion may disqualify any entrant who uses third party proprietary content without consent at any time and/or edit any Submission to blur out any trademarks or to remove any copyrighted content;
Submissions must not contain any reference to, or likeness of, any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence.
Submissions must not include any illegal, defamatory or in any way obscene or other objectionable or inappropriate content, as determined by the Sponsors in their sole discretion. Submissions cannot be a parody or derogatory.
By entering the Contest, each entrant: (i) represents and warrants that his/her Submission is his/her original work and does not infringe on any third party’s copyright, trademark or other intellectual property rights; (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Submission, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Sponsors an unlimited, royalty free, irrevocable, right and license to publish, reproduce and/or use his/her Submission in any and all forms of media without notice or compensation; (iv) waives all moral rights in the Submission in favour of the Sponsors; and (v) agrees to release and hold harmless the Sponsors and their respective directors, officers agents, representatives, successors and assigns from any claim or liability arising from or related to the Submission and/or his/her participation in this Contest. The Sponsors assume no responsibility for any claims with respect to the Submissions.
General
By entering the Contest, entrants agree to abide by these Rules and further agree that the decisions of the Sponsors are final. The Sponsors reserve the right at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsors reserve the right, in their sole discretion, to disqualify any individual they find to be tampering or disrupting the entry process, operation of the Contest or acting in violation of these Rules. The Sponsors do not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. In the event of a dispute, entries will be deemed to have been made by the Authorized Account Holder of the Account used to submit the entry. “Authorized Account Holder” means the person who is assigned to an Account by www.facebook.com. An entrant may be required to provide proof that he/she is the Authorized Account Holder of the Account that submitted the applicable entry.
Privacy and Personal Information
By entering the Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by CKXS for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of Five Amigos Broadcasting Inc. which is located at https://ckxsfm.com/privacy-policy/. CKXS will not sell or transmit this information to third parties unless CKXS believes in good faith that it is required to do so by law. Any inquiry concerning the personal information held by CKXS should be addressed to CKXS at 520 James Street, Wallaceburg, ON, N8A 2N9.
Publicity of Winner’s Name
The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has returned a fully completed contest eligibility and liability/publicity release to the Sponsors as set out above. By entering the Contest, each entrant consents to the use of his or her name, image, likeness and photographs, without compensation, in any publicity worldwide that is carried out in any media by or on behalf of the Sponsors.
Subject to Applicable Laws
This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
