A new court date has been set as the Municipality of Chatham-Kent continues to push back against plans to reopen a dormant landfill near Dresden.
Originally scheduled to take place this morning, an initial hearing between York1 Environmental Waste Solutions and the municipality has been rescheduled to March 17 at Superior Court in Chatham.
Back in November, York1 served the municipality with a court challenge, arguing that the proposed landfill development on Irish School Road does not require any land use planning approvals from CK Council.
Officials say the initial appearance on March 17 is procedural in nature and will not involve a hearing on the merits of York1’s application. Rather, it is a scheduling step that allows the parties and the Court to establish a clear process and timeline for how the matter will proceed.
It is expected the Court will set deadlines for the exchange of materials between the parties and identify timelines for any cross-examinations that may be required.
Further updates will be provided to the public as the matter progresses and as additional information becomes available through the court process.
